AMMAN --- March 5, 2008--- The Higher Court of Justice is expected to issue a ruling tomorrow, Thursday, March 6, 2008, in the lawsuit filed by Mr. Talal Abu-Ghazaleh, Chairman and CEO of Talal Abu-Ghazaleh Organization (TAGorg) on the illegality of expropriation of TAGorg’s buildings in the Abdali area.
Mr. Abu-Ghazaleh has filed a complaint at the Amman Conciliation Court against Engineer Omar Al-Maani both in his personal capacity and as the Mayor of Amman. The complaint alleges that Mr. Al-Maani presented false evidence relating to the expropriation case, in contravention to the regulations of Article 266 of the Penal Code. The first of the sessions looking into this case will take place today.
TAGorg is also preparing to present a lawsuit to the Civil Court demanding compensation for damages due to the abuse of authority by the Greater Amman Municipality (GAM) and its illegal procedures since June 2005.
Back on February 12, 2008, Mr. Abu-Ghazaleh announced in a seminar convened by the Arab Organization for Human Rights (AOHR) that he will not evacuate TAGorg buildings since the case is still in court.
The case began when Al Abdali Investment and Development PSC, began its “Abdali Urban Regeneration Project” in the area. The Amman Municipality decided to expropriate TAGorg’s buildings, under the pretext that including them for the "Abdali Project" would be in the public’s interest.
Mr. Abu-Ghazaleh, however, maintains that the Abdali project is in reality a private one, adding further that since the Mayor of Amman is also affiliated with Abdali Investment and Development PSC, there is a clear conflict of interest.
